City officials defendants in law suit

Miamisburg-- Fomer Miamisburg city prosecutor Ronald L. Fobes is seeking more than 300,000 in back wages and unused sick leave and has filed a lawsuit against the city, its manager and finance director. Fobes who now lives in Orlando Fla. was hired Jan. 22, 1995 and retired July 2, 1999 with 2,510.15 hours of unused sick leave, according to the lawsuit filed Nov. 23, in montgomery county common pleas court in Dayton. The lawsuit names as defendants City Manager John K. Weithofer and City Finance Director George Perrine. The amount of sick leave, figured at one days pay for to days unused sick leave, is 36,532.24 according to the lawsuit. He asks an amount exceeding 25,000 plus ten percent interest per annum. Fobes also seeks relief in an amount exceeding 25,000 plus ten percent per annum, for the cities failure to convert his sick leave and he seeks 268,261.48 for the counties portion of payment from 1985 to 1999 to him as prosecutor for services rendered in prosecuting criminal cases arising within the unincorporated arears of the courts jurisdiction.Fobes also requests a jury trial and payment of attorney fees and costs. The city had not received a copy of the filing and had no comment.

City Council appoints new prosecutor

Miamisburg, Ohio December 8, 1999: Miamisburg City Council last night at its regular meeting appointed Christine L. Burk as the new City prosecutor, succeeding Ronald L. Fobes, who resigned in June.

Burk has over eight years experience as a prosecutor in the Miami Valley. Since March, she has served as an assistant prosecuting attorney with Greene County, responsible for the investigation and prosecution of all felonies involving sexual assault, domestic violence and child abuse. Prior to joining Greene County, she served as an assistant prosecutor with Montgomery County since 1991.

"The interviewing committee for the prosecutors position, which included two members of City Council, was very impressed with the quality of applicants and had a challenging selection process," Mayor Dick Church, Jr., said. "Christine emerged as the recommendation of the committee, and City Council accepted that recommendation unanimously. She has impressive credentials as a prosecutor, and has worked closely with law enforcement agencies in this region for several years."

Burk was admitted to the Ohio Bar in November 1990 following graduation from the University of Dayton School of Law. She previously earned a B.A. degree in business administration from Wittenberg University. In addition to her prosecuting responsibilities, she also is a part-time instructor in the Criminal Justice Department at Sinclair Community College.

The prosecutors position is one of four appointments made by City Council, along with city manager, law director and clerk of council.
